TERMS AND CONDITIONS

These terms and conditions (Agreement) refer to the contract between Joan Hayden and the parents in respect of the guardianship for your son/daughter.

You bestow upon the guardian Joan Hayden the right to act in loco parentis in any situation, particularly in emergencies including the signing of permission for medical/surgical treatment.

 

Guardianship Responsibilities

Joan Hayden accepts responsibility for the guardianship of your son/daughter on the understanding that all pertinent information about your son/daughter has been revealed and your son/daughter will comply with the requirements of our guardianship service.

Should your son/daughter be suspended or expelled from school Joan Hayden will continue to provide the guardianship service subject to sufficient funds being held to cover additional expenditure. In the case of insufficient funds immediate payment will be required to secure the service continuation.

Joan Hayden will undertake all reasonable care to protect your son/daughter's rights and to inform you of any circumstances, which may adversely affect them.

Joan Hayden will endeavour to exercise the same duty of care as a responsible parent would in relation to their son/daughter. The amount of independence allowed will depend on the age and personality of your son/daughter. Any specific restriction you wish to be placed on your son/daughter should be given in writing. There may be occasions when your written consent is required to a particular arrangement.

The guardianship agreement authorises Joan Hayden to agree to any emergency medical or dental treatment, as deemed necessary. This right will only be exercised if your prior consent has not been possible.

All helpers and any host family used will always be CRB checked (Criminal Record Bureau) with a full CRB certificate providable as proof.

 

Parents Responsibilities

Parents must complete and sign the guardianship application form, giving details of their address and contact numbers for any hour of the day or night

Parents must notify me of any changes in family circumstances which may be relevant and which may affect the son/daughter .Also any changes of address and/or contact numbers. Parents must also notify me of any health conditions, medication and allergies pertaining to their son/daughter

Parents are responsible for taking insurance cover for personal accident, loss, or damage to belongings, private healthcare and third party risks ,I do not accept responsibility if loss or damage is caused by wilful neglect whilst they are under my care. I strongly advice that insurance cover is taken out.

Any monies left from the deposit will be returned at the end of the school year or contract, less any expenses. An account will be sent at the end of each term

Invoices will be sent for any extra expenses incurred on behalf of your son/daughter. These must be paid upon their receipt

In the event that the guardianship fee is not received on time the contract will be deemed to have been broken and the guardianship service will not be provided. The parents and the school will be notified in writing

You must inform Joan Hayden in writing if you wish to withhold your consent to your son/daughter participating in any sports or other physical activities, which may result in some form of physical injury.

You are responsible for

  • Ensuring that appropriate insurance cover is arranged for your son/daughter, e.g. medical, travel, sickness and personal injury and providing a copy of same to Joan Hayden.
  • Informing Joan Hayden directly about any concerns about your son/daughter's welfare or safety you may have so that appropriate action can be taken
  • Ensuring that your that your son/daughter is receptive to guidance, and that the son/daughter accepts the responsibility of Joan Hayden, and the school to act in the best interest of the son/daughter's education and welfare. The following rules must be reasonably understood and adhered to:
  • It is obligatory to comply with the rules of the school and the Headteacher.
  • It is not permitted for a student to travel independently without prior permission
  • United Kingdom laws must be obeyed, especially regarding alcohol tobacco and drugs.

A son/daughter may be expelled from guardianship for serious or continual misconduct, particularly where such behaviour prejudices the safety or progress of other son/daughterren or brings the school into disrepute.

Any suspension of the guardianship service means that Joan Hayden relinquishes all legal liability, including the responsibility for any practical arrangement during any period of such suspension.

 

Code of Conduct

Behaviour during the school breaks: Half terms and exceats

 

Whilst your son/daughter is staying in my care and guardianship I will expect the following

• We expect all children to be polite and to be courteous at times, to us and to whoever they are with.

• If a son/daughter is deemed not to be of excellent behaviour they would not be accepted on any of the trips, they must show they are able to take instruction and to follow what they are told

• In our home they are to be tidy and to leave everything as they find it in the bedrooms and bathrooms

• Never to use the land line without asking permission first, it is just polite to ask, it is not a problem but is very expensive and a charge would be made

• No alcohol in any circumstances if any son/daughter is found to use any intoxicating substances the guardianship agreement would be broken and cancelled

If there is such an occurrence then parents and the school would be notified and I would have the right to relinquish my guardianship with no return of fees.

 

Fees

You are liable to pay the full first terms fee upon the signing if this registration form.

You are jointly responsible with any person or organisation appointed by you in writing are for payment of fees including the guardianship fee, registration fee, expense deposit.

 

Registration Fee

The Registration Fee is a one "off fee", which is not refundable and must be sent together with the completed application form.

 

Guardianship Fee

This fee constitutes the remuneration either termly or annually for Joan Hayden's guardianship service and does not cover additional expenses such as UK travel, accommodation outside the school, pocket money, mobile phone and airplane tickets.

 

Expense Deposit

The Expense Deposit is an amount to paid at the beginning of every term to cover your son/daughter's pocket money, mobile phone, airplane tickets, and additional travel. It is monitored regularly and should be maintained at the level proportionate to the expenditure incurred by your son/daughter for each term.

 

Payment of Fees

All invoices must be settled in full one month before the start of every term. Late payment charge of £150 will automatically apply whenever an invoice is not paid by the stipulated time.

All invoices relating to Travel and Expense Deposit must be settled within two weeks of issue of invoice.

At the end of the guardianship term any unspent funds are fully refundable on written request from you. Once you have accepted my terms and paid the invoices, Joan Hayden is unable to refund any part of the Guardianship Fee, whether or not the service is taken up.

Should your son/daughter not use my service for some time, be it for personal or medical reason, any refund will be at my absolute discretion.

 

Termination of Guardianship Contract

To withdraw your son/daughter from the guardianship agreement one full terms notice is required in writing. A terms notice means notice given before the first day of term as defined by the school and expiring at the end of a term.

If insufficient notice has been given a terms fees in lieu of notice will payable.

I herby appoint Joan Hayden to act as guardian in respect of the pastoral, education and physical welfare of my son/daughter. Joan Hayden has my full permission to consent to medical treatment as is thought proper and necessary in the event of an emergency and on the advice of suitably qualified medical personnel;
